Justice Kennedy’s retirement triggered a meltdown among Dems who want only one thing, to block his replacement’s appointment until they take the White House or the Senate. There’s a lot of screaming about “vengeance for Merrick Garland”.
Except…
1. The Garland nomination was a sham. Hillary Clinton made it clear that she wouldn’t nominate him.
2. Blocking a nomination at the end of the term is the Biden rule. No presidential term is ending here.
3. In both cases, Republicans are being replaced by Republicans. Kennedy was just a particularly flaky swing vote. Dems aren’t entitled to either seat. And it’s not as if Ruth Bader Ginsburg is even being replaced.
